Hiring an attorney when you file for divorce is a good idea but isn't always necessary. Many resources are available if you decide to file for a divorce without the assistance of a lawyer. The upside is that it's less costly. However, you and your spouse must be able to agree on divorce terms.

Visit your courthouse. Many courthouses provide self-service document centers where you can print the necessary documents to file for divorce in your county.

Search the Internet for "do-it-yourself divorce" websites such as Legalzoom.com. The documents are provided on the websites for a fee and all you have to do is fill in the blanks.

Go to a national bookstore chains such as Barnes and Noble sell divorce kits, many complete with instructional CDs.

Make an appointment with a mediator. Seeing a mediator does not require a lawyer or judge. Doing so helps you and your spouse get the opinion of an unbiased third party and will help settle disagreements.

Be sure to deliver divorce papers through Certified Mail and check the box labeled "Return receipt requested" to be sure that your spouse receives the proper paperwork.
Choose a national divorce kit. Since many states differ on divorce laws, a national kit will prevent you from having to do extra legwork finding your state's specific laws.
If you and your spouse can't come to an agreement about child custody and the division of assets, it is likely that you will need the assistance of an attorney.
Many states require that you publish the divorce filing in a newspaper where your spouse lives. If you don't know where your spouse is living, his last known address is acceptable.
