How to Prove Libel
Libel is printed or, in some states, broadcast defamation--an expression of printed words and statements that damage a person's community standing and integrity by attacking the individual's character or professional abilities. The plaintiff, the person who files the complaint, bears the burden of proof and therefore must show that libel did in fact occur. Follow the steps to learn how to prove libel.

Show defamation. Prove that there was in fact defamatory language that shows badly on your morality or integrity or questions your credibility in your profession.

Explain identification. Show that the libelous statements in question refer to you and show that at least one reader could identify you as the defamed person.

Demonstrate publication. Prove the public received--generally that they read--the libelous statements.

Prove fault. Show negligence or recklessness, if not intent to defame, on the part of the defendant.

Establish falsity. Prove that the published statements were untrue. You only need to prove this in cases involving public concern.

Confirm personal harm. Show the loss of reputation, emotional distress or money. If there was no personal harm done, and instead the published statements just caused annoyance, for example, there is no libel suit.

How to remove Internet based defamation and online libel My how to is not yet complete, but I will post a completed paper soon. I am looking for other how-toers to help me with my paper. I am currently researching the evolution of internet based defamation and online libel and its financial, emotional and commercial impact. I am also studying the worlds legal systems attempts to keep up with the internet explosion as it pertains to freedom of speech. I will appreciate if lawyers, free speech enthusiasts and technology people who have valid comments contact me with their thoughts. Also, please send me links to any good reference material that you know of. Based on my research, winners in court are far and few between. But online slander, libel & defamation is obviously a significant problem. These guys make a living out of getting online libel removed with out-of-court solutions -
