How to Draft a Drug and Alcohol Policy

Many employers these days are choosing to develop and enforce a drug and alcohol-free workplace to help ensure worker productivity and to decrease safety issues arising from drug and alcohol abuse in the workplace. Here are some tips to consider when drafting an alcohol and drug policy.

Step1
State the purpose of the policy. The policy should clearly convey to the employees that its purpose is to promote a work environment free of illegal drug and alcohol abuse. The policy should state that it applies to all employees, including temporary and part-time employees, and that compliance with the policy is a condition of continued employment.
Step2
Describe what is prohibited under the drug and alcohol policy. At a minimum, possessing, using and selling illegal drugs should be prohibited under the policy. Being under the influence of alcohol or drugs during work hours or while performing company business should also be prohibited.
Step3
Explain the procedure for dealing with violations. The alcohol and drug policy should clearly state the penalties and corrective action that would ensue from any violation of the policy.
Step4
Develop an employee assistance program. Consider implementing an assistance and referral program to professional addiction and rehabilitation services for those employees experiencing alcohol or drug problems. Encourage employees to refer themselves to the employee assistance program if they require help to recover from or treat alcohol or drug abuse.
Step5
Make sure the employees are aware of and understand the alcohol and drug policy. Have the employees sign the policy to indicate that they have read it and agree to comply with it. Include the policy in the employee handbook.

  • You should have an experienced employment law attorney review your alcohol and drug policy to ensure that it complies with federal and state laws.
  • If you decide to implement drug testing as part of your alcohol and drug policy, make sure that you use a certified lab to process the results, provide a second drug test if the first test is positive and make sure all drug testing results are kept confidential.
