How to Create a Harassment Free Workplace

Sexual harassment is a form of discrimination that is prohibited by federal law. Employers can be liable for sexual harassment even if they are unaware that such conduct is taking place. Employers should therefore take reasonable care to prevent and correct any sexual harassment behavior within their workplace. Here are some tips to help create a harassment free workplace.

  1. Step 1

    Develop a harassment and discrimination policy. Have your attorney review the policy to ensure that it is consistent with the law. Communicate the policy to all employees by posting it in the workplace and including it in the employee handbook. Have all employees sign the policy to indicate that they have read it and understand it. A zero tolerance harassment policy is a crucial step in creating a harassment free workplace.

  2. Step 2

    Provide a procedure for dealing with complaints. Make sure your employees know who to complain to should harassment occur. Investigate all complaints promptly and thoroughly. Follow up with the employee making the complaint after the dispute is resolved to ensure that there was no retaliation.

  3. Step 3

    Organize training sessions. Training sessions can be helpful in educating your employees as to what kind of behavior constitutes harassment and providing examples of conduct that is inappropriate in the workplace. Training can consist of video presentations as well as reading material.

  4. Step 4

    Document everything. Always document the results of any harassment claim or investigation, as well as any corrective action taken. The documentation should be through and accurate and be prepared at or very near the time of the event.

    Communicate to employees that it is their obligation to report any harassment experienced or witnessed. Employees need to be aware of their role in helping to create a harassment free workplace.
