Step 1
Look at other sample demand letters for elements such as terminology and structure. The Settlement Central website has several good sample demand letters; however, different types of cases require different types of demand letters, so make sure you are looking at the right samples for your situation.

Step 2
Start your letter by stating who you are and why you are writing the letter. This opening statement should be direct; "I have been requested to file suit against you for…" and "I have been retained to file suit against you for…" are phrases you can use to start your letter.

Step 3
State your facts. Recite events exactly and why a dispute resulted, list any injuries you sustained, treatments you received, any medical expenses you incurred and any income lost.

Step 4
Demand action from the other party. This is where you reveal your desired settlement. It can be simple or complicated, depending on what you want for payment for the suffering you experienced. Usually a lump sum payment your insurance company determines suffices.

Step 5
Conclude your letter with a threat. "Consider the consequences and govern yourself accordingly" is a good one. Promising "unpleasant action," "further action" or "legal action" is effective as well.
