Auto theft is a serious crime and all too common. Hundreds of cars are stolen every day across the country. New cars and sports cars rank among the most commonly stolen vehicles, yet any car can be a target if it is not properly secured. Like most states, Indiana has tough penalties in place for people who steal cars. If you have been the victim of auto theft in Indiana or have been charged with this crime, you need to find out what the penalty could be.

Instructions

Difficulty: Moderate

Things You’ll Need:

Step1
Speak with qualified legal counsel if you are accused of auto theft. Only an attorney who specializes in criminal law can give you completely accurate, honest information on the penalty for auto theft in Indiana. You will want a local attorney to help you, as different states have different laws. Use the resources of the American Bar Association (see Resources below) to find the right attorney for you.
Step2
Look online for information on Indiana state law. This information can be found in the Indiana state Legislative Code (see Resources below). The Legislative Code contains the actual text of state law and penalties for breaking those laws. Information on auto theft is found in Title 35, Article 43, Chapter 4, Section 2.5.
Step3
Understand that in Indiana, auto theft is a Class D felony offense if you are a first-time offender. However, if you are a repeat offender, this becomes a Class C felony crime, which is a more serious offense.
Step4
Know that a Class D felony in Indiana carries a minimum prison sentence of 6 months. A Class C felony carries a minimum sentence of 2 years.
Step5
Get the support you need if you are a victim. After finding out about the penalty for auto theft in Indiana, if you feel you need help in dealing with being the victim of theft, contact the National Center for Victims of Crime (see Resources below).

Tips & Warnings

  • There is a wide range of anti-theft instruments you can install on your car that will discourage thieves. Wheel, ignition and hood locks are popular, as are car alarms and electronic tracking devices. Protect your car to the best of your ability by investing in one or more of these security instruments.
  • Crime victims have rights in Indiana, including victims of auto theft. Among your rights are the right to be treated with respect by the police and courts and the right to bring a civil suit for restitution against the person who stole your car. You also have the right to be notified if the thief is sentenced to prison and later escapes.
  • Never hide a spare car key anywhere on your car. This is practically an invitation to car thieves to steal your vehicle. There are only a few places on a car where a key can be hidden and seasoned thieves know where to look.
