Owners of limited liability companies must file Form 941 if they have paid wages and withheld federal income tax, local taxes, Social Security and Medicare payments. Owners who operate farms as businesses also must complete Form 943. Follow these steps.

Obtain Tax-Filing Information and Forms

Step1
Call the IRS at (800) TAX-FORM to request an "Employer's Quarterly Federal Tax Return" Form 941 or 943.
Step2
Order your forms and make sure to time it so that you can file for each quarter's deadline.
Step3
Go to the IRS website for instructions and forms that you can print out (see Resources below).

Complete a 941 (or 943) Form for a Limited Liability Company

Step1
Consult an experienced tax accountant who has experience filing quarterly 941's. Visit the FindLaw Web site to find professional advice (see Resources below).
Step2
Review the 941 and note what information you must list. Check the box that indicates the quarter in which you are filing. Enter your name, limited liability company name (trade name), address and your employer identification number (EIN). Complete all the required sections.
Step3
Enter the total number of people you employ, their wages and tips and the total income withheld.
Step4
Utilize e-file at the IRS Web site to file your 941. Filers typically receive a 3-week turnaround when they file electronically. You also can mail your form to the official IRS office.

Tips & Warnings

  • Check the status of your claim with the IRS 6 weeks after filing it.
  • The government requires you to file a 941 or 943 every quarter, even if you have no taxes to report for the period or did not pay any wages.
  • Be careful when entering your EIN on the 941 form. If this information is wrong, the IRS can charge you certain penalties, and your return might be delayed.
