Obtaining a marriage license is an important step in making your marriage legal. Follow these guidelines on how to obtain a marriage license if you plan to wed in South Dakota.

Things You'll Need:

  • Marriage license application
  • Pen
  • Cash (check individual counties for other forms of acceptable payment)
  • Photo identification
  • Divorce decree or death certificate, if applicable
  1. Step 1

    Obtain an official marriage license application in person at any Register of Deeds office in a South Dakota county. Only an unmarried male and unmarried female may marry in South Dakota. Applicants may apply for a license in any county regardless of residence within the state.

  2. Step 2

    Present valid photo identification, such as a driver's license or passport.

  3. Step 3

    Complete and sign the application.

  4. Step 4

    Pay the license fee and head to the altar. License fees and acceptable forms of payment vary among counties.

Tips & Warnings
  • If either applicant was previously married, the date of divorce or date of spouse's death must be provided. Bring a certified copy of the divorce decree or death certificate.
  • There is no waiting period. The license may be used immediately anywhere within the State of South Dakota.
