The DUI (Driving Under the Influence) charge varies in consequence and even in name in some states. You may hear DWI, which is Driving While Intoxicated, or even OWI (Operating While Intoxicated) and OUI (Operating Under the Influence). Penalties if convicted often include losing your license. Here's how to avoid license revocation.

Instructions

Difficulty: Moderately Challenging

Step1
Some states will take away your driver's license on the spot after you fail a breath test during a police stop. Even if this not the case in your state you'll need to find good legal representation. A defense attorney will explain the law and your rights. For help finding a lawyer consult the directory of the National Association of Criminal Defense Lawyers (see Resources below).
Step2
Decide what you and your lawyer will argue regarding your need to have your license. In some states, depending on number of prior convictions, an emergency or limited driver's permit may be issued. This will allow you to drive to and from work, and sometimes to appointments that are absolutely necessary. Each state is different, so confer with your lawyer as to your best approach.
Step3
Ask your lawyer how you can minimize the effect of a DUI conviction so that your future finances and employment will be affected as little as possible.

Tips & Warnings

  • Getting a good lawyer does not necessarily mean using your regular lawyer or a family lawyer. Lawyers who specialize in DUI law should be consulted to learn how to avoid losing your license.
  • Many DUIs occur as the result of alcohol addiction. Contact a support group such as Alcoholics Anonymous through the American Council on Alcoholism Web site (see Resources below) to get help.
  • If you cannot afford a lawyer, it is your right to be represented by a public defender.
  • Not only could you lose your license after a DUI, but your job opportunities might become limited. Employees with security clearances may be terminated after a DUI conviction. It will also increase your insurance rates. Be aware that a difficult and costly time is ahead after a DUI arrest.
