How to Apply for a Marriage License in Pennsylvania

So, you’ve decided to get married--great! But before you can get married in Pennsylvania, or in any state, there are a few legal hurdles you will need to clear in order to obtain a marriage license.

  1. Step 1

    Determine your eligibility for marriage. If you were previously married, you will need a copy of either the divorce decree or the certificate of death of your previous spouse. Same-sex marriages are not permitted in Pennsylvania. Persons under 18 wishing to marry may do so, but they require additional forms and parental consent. Cousins are not allowed to be wed in Pennsylvania.

  2. Step 2

    Gather the necessary documents. Before you go to get your license, you will need identification. Your driver’s license or other state-issued ID is usually sufficient. You will also need to know your Social Security number, although the card may not be requested.

  3. Step 3

    Go to the clerk, courthouse, or register in your county responsible fro issuing marriage licenses. You can find out the location for your county by checking the phone book or your town’s Web site (see Resources below).

  4. Step 4

    Pay the fee for your marriage license. In most cases, this fee will generally be $40, although for minors and people wishing to waive the waiting period, this fee may be higher. Bring cash.

  5. Step 5

    Wait at least 3 days. Pennsylvania has a waiting period of 3 days between the time you get your marriage license and the time when the ceremony can be performed. You can have this waived by contacting the courthouse or registrar that grants the license as early as possible to request a waiver.

  6. Step 6

    Get married. In Pennsylvania, the marriage license expires 60 days after it is issued.

Tips & Warnings
  • Bring cash to the clerk’s office.
  • Pennsylvania has a self-uniting marriage license available. Tell the clerk if you need this type of license before you start the application process.
  • Apply for your marriage license about a month before you plan to get married. The extra time will give you a cushion in case you run into any problems.
