How to File Taxes If You Are in a Same-Sex Marriage in Massachusetts

Although Massachusetts recognizes the union of a same-sex couple as a marriage, the federal government does not see it quite the same way. This makes for some complications when you file taxes if you are in a same sex marriage in Massachusetts. What this means is that you'll enjoy tax benefits at the state level but will still have to file your federal income taxes separately. Here's how to file taxes if you are in a same-sex marriage in Massachusetts.

Things You’ll Need:

• One state income tax form
• Two federal income tax forms

1. Fill out your federal tax forms individually. Each spouse should file a separate federal tax form and claim single status.
2. File your state income tax form as if you were married. You can mark your status as "married filing separately" or "married filing jointly."
3. Combine the figures from the two federal tax forms if filing jointly. Fill in your joint state income tax form with the combined figures.
4. Take deductions, credits and exemptions as if you were married. On your state form, fill it out as if you were in a traditional marriage.
5. File electronically or mail in your forms.

Tips & Warnings

• You might want to provide a cover sheet on your federal tax form indicating that you are indeed married, but marking single for tax purposes only.
