A trademark is a unique word, name or symbol linked to a certain business.

Step1
Obtain an application form from the U.S. Patent and Trademark Office (USPTO) or access one online at its website.
Step2
Fill out the application.
Step3
Create a drawing of your mark, be it a word or design. If you are submitting an online application, either type in the mark (if it is a word) or attach a graphic file in "gif" or "jpeg" format (if it is a design).
Step4
If you are already using the mark, include a digital image of your mark with your online application, or a photograph of the mark with your paper application.
Step5
Calculate your filing fee, which will depend on the number of classes, or ways, the mark is used. Each class has a $245 fee.
Step6
Submit application electronically or by mail to USPTO.

Tips & Warnings

  • Use the electronic application form for faster filing.
  • To find out if a mark is already taken, visit a Patent and Trademark Depository Library or access the online USPTO Trademark Database.
  • USPTO will respond usually within 6 to 7 months, but the entire application process may take 1 year or more.
  • Trademark protection remains in effect for 10 years.
  • Once the application has been received, USPTO will not refund the fee.
  • Many foreign countries do not recognize trademarks registered in the United States.
  • Trademark applications consisting primarily of a name, or obscene or deceptive words, will probably be rejected.
  • Hire a trademark attorney if you can afford one.
