How to File a Lien for Unpaid Homeowner Assessments in Michigan
Michigan law allows homeowners associations to place liens against real estate for delinquent association fees. Property liens cloud property titles and may eventually lead to foreclosure. Michigan law requires homeowners associations to follow strict filing requirements for liens. A Michigan homeowners association should seek an attorney's advice before recording a lien to ensure compliance with state law.

1
Mail or hand-deliver the completed lien to the register of deeds for the county in which the property at issue is located. Supply the original lien to the register of deeds not a photo copy.
-
2
Provide the appropriate filing fee with the original lien at the time of recording. Check in advance with the register of deeds to confirm the fee amount since Michigan county fees vary. Pay the fee with a check or money order made payable to the county's register of deeds. Do not send cash.

-
3
Provide a stamped, self-addressed envelope to the register of deeds. Attach a cover letter with instructions to file the deed and return it once it is recorded if it is being sent by mail.
-
4
Recorded liens should be safely filed and maintained. Keep the recorded lien in a safe place once it is returned. Serve a copy of the lien on the property owner and keep proof of its service for the homeowners association's records.
