How to Terminate a Guardianship in Utah
A Utah guardianship must be formally ended by filing in court once the guardianship is no longer needed or the guardian can't or doesn't want to continue to act as such. A guardian is legally responsible for the health and well-being of the person the guardianship is for, referred to as a ward. You may end a guardianship in Utah for a variety of reasons, including the death of the ward, the ward regaining competency or turning 18 if a minor and the death of the guardian.

Prepare a final accounting of the ward's estate. Utah law requires you have a final accounting of the ward's assets when filing for termination. The account must show all of the ward's current assets -- including balance, account numbers and property values -- and living expenses.

Make a list of all persons you must notify. Utah law requires you send a copy of the filed motion and the notice of the right to object to the ward, the guardian (if you're the conservator) or the conservator (if you're the guardian), and the living heirs of the ward. You need the names and addresses of all persons you're sending notice to.

Visit the Utah District Court that issued the guardianship. Ask for the motion to terminate guardianship, notice of right to object and the certificate of mailing forms.

Complete the motion form. You need the following information: the name and address of the guardian, the ward and conservator (if one was appointed), the date of the guardian's appointment, the case number and the reason for the termination. Sign and date the motion. Attach the final account to the motion.

Fill out the notice of right to object form. You need the case number, the names of the forms you're filing, the name of the ward and the name of the person you're sending the notice to. Don't fill in the name of the person you're sending notice to before making copies. Make copies of the form with that field blank; you need one copy for each person you must notify. Fill in the individual names after making the copies.

File the motion. Ask for copies of the filed motion; you need one copy for each person you must notify.

Mail a motion copy and the right to object to each person you must notify. Utah allows you to send the documents through first-class mail, but consider using certified mail with a return receipt so you have proof of mailing.

Complete the certificate of mailing form. You must list the names and addresses of all persons you sent the motion and notice to object to. Enter the date you mailed the papers on.

File the certificate of mailing form in the Utah District Court. You will be notified of the hearing on the termination by mail.
