How to File Amendments for Bankruptcy

The information on your credit report is not always a comprehensive resource for preparing your bankruptcy filings. Even going through all bills and notices can leave certain debts out of the mix. If you forget to list a debt or have to make other amendments to your bankruptcy, you should do so as soon as you discover the issue. Amendments can but don't always delay the proceedings.

Instructions

    • 1

Call the trustee assigned to your case. His name and telephone number is listed on your bankruptcy petition.

    • 2

Explain to the clerk what modifications you need to make and why. Ask what forms are required to make the amendment. Some trustees require a full refiling of the entire form, while others might only need the new information added to the correct section while leaving the rest of the form blank. Be sure to find out what your trustee needs. Confirm if you need to include copies of the original and whether a cover letter explaining changes is required with the amendments.

    • 3

Obtain the required forms at the bankruptcy court clerk's office, trustee's office or by visiting the bankruptcy courts website at USCourts.gov/FormsandFees.

    • 4

Complete the forms and file them with the trustee, noting "AMENDED" along the bottom margin. Make sure your case petition number and name are accurate and complete.

    • 5

Pay the appropriate filing fee for the amendment if there is any. Not all amendments require a fee.
