How to Remove a Boyfriend From a Lease

A new lease will be necessary after you remove your boyfriend.

Signing a lease with a boyfriend as a co-tenant seemed like a good idea at the time, but it didn't work out, and now it's time for him to go. However, he is as legally responsible for the rent as you. Removing a boyfriend from a lease takes an understanding landlord and an agreement by all parties involved, including the boyfriend.

1. Discuss the subject with the boyfriend. Remind him that staying on the lease legally obligates him to pay the rent until the lease ending date. Explain that getting his name successfully removed from the lease will be in his best interest financially. Ask him to join you in a joint request to the landlord to have his name removed.

2. Contact the landlord. Write a letter, send an email or pay a personal visit. Without going into detail, if there is drama involved, let the landlord know the boyfriend would like to move out and have his name removed from the lease. If the boyfriend is present at the meeting, have him verify his desire to be removed.

3. Assure the landlord that you will be able to pay the rent yourself, or you will find another roommate. Show the landlord pay stubs and bank statements detailing your ability to handle the rent if he lets the boyfriend off the lease. If you will need another roommate, line up several viable candidates before meeting with the landlord. Have their contact information, credit reports and proof of income at the meeting.

4. Draw up a new lease. The landlord is responsible for deciding whether to let the boyfriend off the lease. If he agrees, ask him to let you sign the new lease as soon as possible to settle the matter.

5. Sign the new lease, take the keys away from the vacating boyfriend and enjoy the property.

• Maintain a professional and calm attitude throughout the process. It shows your landlord you will pay the rent, and shows the boyfriend he has nothing to lose and everything to gain by helping get the lease re-written.

• If the landlord or the boyfriend refuse to have the boyfriend's name removed, nothing can be done; you must wait it out and pay the rent until the lease is up.
