How to Make a Contract for Selling a Vehicle

If you are selling your car yourself, you must have a contract --- sometimes called a Bill of Sale --- to give the person purchasing your vehicle. You do not need an attorney to write a contract to sell a vehicle. As long as the contract protects you and includes all of the required information, you can write it yourself and prevent paying an attorney fee. You can write your contract on a blank sheet as long as your handwriting is legible.

      Look over the laws of your state can help you ensure that the contract you make is legally binding. DMV.org provides a list of the requirements you must meet in each state to write a legal contract for selling a vehicle.

      Include the date, your name and address and the name of the buyer and his address in the first line of the contract.

      State that the buyer is purchasing the vehicle. Write the description of the vehicle including the make, model and year. Make sure you include the Vehicle Identification Number with the description.

      Write the odometer reading of the vehicle and include a disclaimer that states that the odometer reading is correct to the best of your knowledge. Include a statement certifying that you are not aware of anyone changing or adjusting the odometer prior to the sale.

      Declare that the buyer is purchasing the vehicle "As-Is," and include the selling price. State that you are not providing any type of warranty and that the buyer is responsible for any necessary repairs.

      Include spaces for you and the buyer to sign your name and spaces for any witnesses to the transaction.

  • Your state may require that you have the contract notarized, if so, include a space for the signature and stamp of the Notary Public.

  • Make a copy of the contract for the buyer.

  • If you are not truthful about any known defects of the vehicle, the buyer can sue you for fraud.
