What Happens During an Arrest for a DUI?

  1. Stop

    • If a police officer sees you break a traffic law, or suspects that you are driving under the influence of drugs or alcohol, he will stop your vehicle.

    License and Registration

    • After being stopped, you will be asked for your license and registration. This allows the officer to check your driving record and determine whether you are wanted for any other crime.

    Field Sobriety Test

    • If the officer suspects you were driving under the influence, he can conduct a field sobriety test. During the test, the officer will ask you to perform a series of exercises in order to determine whether you are impaired. The exercises might include walking in a straight line, standing on one foot or making certain hand and arm motions. Failure to pass a field sobriety test provides enough evidence for an arrest.

    Chemical Testing

    • The officer can perform a chemical test instead of, or in addition to, the field sobriety test. A chemical test can be in the form of a breath test, a blood test or a urine test.

    Custody

    • If you have been found to be intoxicated, the officer will take you into custody. In some states, your license will be taken from you at this time. You will be taken to the police station or wherever inmates are booked in your jurisdiction. Depending on your record and the severity of your offense, you will either be released, a bail will be assigned or you will be held pending trial.
