How House Arrest Works
-
What Does it Mean to Be Under House Arrest
-
House arrest is an alternative form of imprisonment whereby the convicted person serves his sentence while in the confinement of his home. When a person is under house arrest, the person may not leave the house unless the court has granted permission and the leave is supervised.
When Is House Arrest Utilized
-
House arrest is utilized at the discretion of the presiding judge in a criminal case. The judge may consider factors such as the convicted person's physical and mental health, the age of the person and the seriousness of the crime. Frequently, young people are confined to the home because there is too much risk to the minor in being placed in an adult prison. Additionally, house arrest is almost always utilized for crimes which do not result in severe consequences, as opposed to more serious crimes such as murder or manslaughter, which carry substantial imprisonment penalties.

How Are House Arrests Monitored
-
House arrests are monitored by the wearing of an electronic device such as an ankle bracelet. The bracelet is placed on the convicted individual at the beginning of the sentence, where it remains until the sentence is over. The monitoring device sends a continuous signal to the police department so the court is aware if the person leaves the confined area. Any breach of the boundaries may result in the person serving her remaining sentence in prison.
