  1. Trademark Search

    • Search the trademark database to determine whether someone is already using the trademark you are attempting to register. Symbols, icons, and letter combinations are commonly used as trademarks so be prepared to discover that many of these types have already been registered.

    Description

    • If your search reveals that your trademark idea has not yet been registered, you need to complete a description of the products or services that will covered by the trademark. If you fail to provide this description, your trademark application will not be accepted. Be as specific in the description as possible.

    Representation

    • Provide a very clear representation of the trademark that you are attempting to register. Two distinct types of representation are allowed. The standard character representation is used for trademarks consisting of letters or words. The standard character representation does not include a design element such as a special font. Stylized representation is for any kind of symbol or words or letters that require a specific font or design. File your application online and pay by check or credit card.

    Review

    • After the trademark office receives your application, there will be a waiting period that usually lasts several months. During this phase, your trademark application will be reviewed and tested to determine whether it violates any existing trademark. If your trademark is found to be in violation, you will receive a letter that explains the reasons for rejection. You will then have six months from the date of the mailing of the objection letter to overcome all the objections listed.

    Complaints

    • If your trademark is not found to be in violation of any existing trademarks, the mark will receive approval. Approval of the mark will be published in the Official Gazette. After publication in the Gazette, anyone who believes that mark has infringed upon their existing trademark will have 30 days to file a complaint or request an extension for filing a complaint. If no complaints are filed, an issue of registration will be filed three months after the Gazette publication date.
