Electric fences are only allowed in certain cases in Ohio.

Temporary electric fences are allowed in the state of Ohio; however, the decision to let an individual erect an electric fence around his property depends on certain factors, such as the purpose of the fence and the consent of nearby neighbors.

  1. State Law on Fencing

    • Ohio state law devotes an entire section to the laws regarding fences (mainly concerning the construction and maintenance of fences). The law refers to any fence-like barrier as a "preferred partition fence," and states that an electric partition fence is legally allowed as long as the "owners of adjoining properties agree in writing" to allow the construction and maintenance of such a fence.

    Misconception

    • Even with the consent of nearby neighbors, there are still further restrictions. A fence made completely of live wires is allowed only in two cases: Either an osage or a blackthorn hedge must be used along with it.

    History of Fencing

    • The existence of so many fence laws can be attributed to Ohio's history. Before 1865, livestock owners didn't have a legal obligation to control their animals. Later, with Ohio's growing population and the increase in conflicts regarding roaming livestock, any owners who didn't fence his livestock risked facing legal action for property damage.
