The Legality of GPS/GIS Use in Pennsylvania

Sometimes the use of technology changes the way things are done in society. The global positioning system (GPS, sometimes global information systems, or GIS)) technology is one such technology. There is some question (as of 2010) as to the legal basis for the way in which Pennsylvania police have used GPS systems.

  1. GPS Technology

    • A GPS unit uses input from satellites to provide location. This system aids navigation and also helps in tracking people or vehicles equipped with GPS devices.

    Tracking

    • Pennsylvania police had used a GPS system in a vehicle used by burglary suspects. With the help of the input from the GPS, they were able to place the location of the vehicle near some burglary sites in suburban Pennsylvania.

    Legality of Use

    • A Pennsylvania county judge initially ruled the police did not have the right to use such evidence. However, in December 2010, judges from Pennsylvania's Superior Court ruled the police could use such GPS tracking evidence.
