E-Verify: Instant employment verfication

E-Verify is the Internet-based verification system used by businesses to ensure employees are eligible to legally work in the United States. The system provides instant verification for employers. It is managed by the U.S. Citizenship and Immigration Services, a branch of the Department of Homeland Security.

  1. The Law

    • U.S. law requires businesses to verify employment eligibility within three days of hire. Federal contractors as well as employers in Mississippi and Arizona are required to use the E-Verify system instead relying solely on information provided by employees on the traditional I-9 documentation.

    Verfication

    • After an employee accepts an offer of employment, an employer accesses the E-Verify data base to obtain the verification results using the information the employee provides on the I-9 form. If an employee is deemed eligible to work, the system posts an Employment Authorized response. If an employee's data cannot be immediately verified the system will post a Tentative Nonconfirmation response, in which case the employee has eight days to resolve the issue leading to this response. Failure to resolve any verification issue results in termination.

    Enrollment

    • Business must register to use the E-Verify system. The registration process, which takes about 30 minutes, involves providing basic information about the business, verifying computer system requirements and obtaining a username and password. Businesses utilizing E-Verify must post notices in all their locations.
