Missouri Death Benefits

Death benefits are available to the surviving dependents of a worker who dies due to a work-related injury, or who was unable to work following a work-related injury and later dies of an unrelated condition.

  1. Dependents

    • The dependents of an employee who dies and is eligible for death benefits are usually described as the surviving spouse and children under 18 years of age. Surviving children can receive death benefits for a longer period if they are full-time students, in which case they can claim benefits until age 22. Also, dependents unable to work due to physical or mental disabilities can in some cases claim death benefits their entire life.

    Payments

    • When an individual dies from a work-related injury, their surviving dependents are eligible to receive a weekly benefit of 66 2/3 percent of the deceased's wages from the preceding year. When an employee dies from a condition unrelated to a work injury, the surviving dependents are typically allowed to receive the accrued benefits of the deceased employee, including pensions.

    Emergency Services

    • Emergency workers in Missouri, such as law enforcement officers and nurses killed in the line of duty are usually entitled to a death benefit from the State of Missouri. Once a death certificate has been issued and verified for insurance purposes, a $25,000 death benefit can be paid to the surviving dependents of a members of the emergency services alongside any other death benefit for which they may be eligible.
