The Arizona DMV Penalties for Moving Out of State With a DUI
Driving under the influence (DUI) is illegal in Arizona. Drivers with an alcohol concentration of 0.08 or higher will be convicted of a misdemeanor or a felony if aggravating circumstances are present. A person convicted of a DUI is subject to fines and criminal penalties.

A first-time DUI offender in Arizona is subject to one to 10 days in jail, a $250 fine, license suspension for 90 days, community service and up to five years of probation (as of 2010). A second DUI conviction results in 30 to 90 days in jail, a $500 fine, license suspension for one year, community service and up to five years of probation. A conviction for an aggravated offense may results in a prison term of up two years and probation for up to 10 years.

A court may place a person convicted of a DUI in Arizona on probation. Probation is for a set amount of time and requires participation in a drug treatment or education program.

Moving out of state without first obtaining permission from the court is a violation of probation. Moving without permission is a violation of probation. The penalty for violating probation may include home arrest.
