Is It Legal to Kick Out an Owner From a Board Meeting?

It is is customary for home unit owners to have the right to participate in association board meetings. The board may adopt rules and regulations regarding the manner, frequency and time owners can participate and remove a disruptive owner from a meeting.

  1. Uniform Condominium Act

    • Most states have a Uniform Condominium Act. Associations must follow their state laws. The bylaws are the governing document for the association and must be consistent with state laws.

    Rules and Regulations

    • Under the condominium bylaws, the board of directors has the authority to adopt rules and regulations. An example would be if the bylaws state that owners can participate at all meetings. The board could adopt rules or regulations setting forth the time and manner in which owners can participate at board meetings as well as other meetings and give the board the authority to remove any disruptive owner from a meeting.

    Amending Bylaws

    • It is not easy to amend association bylaws. There are many steps that must be taken including drafting the amendment, hiring legal counsel to make sure the amendment is legal, noticing a special meeting of the owners, obtaining the required number of owner's votes and sometimes obtaining the approval of an owner's lender if required under the bylaws.
