Missouri laws require a title search to transfer property ownership.

Missouri land title standards are governed by Chapter 442 of the state's Revised Statutes relating to real estate. Sellers must hold clear title to convey real property. A deed change is executed only after a certified title examination.

  1. Real Estate Conveyance

    • Land is considered real property governed by the same laws as the sale of a residential home or commercial property. Conveyance of land occurs after a title search and agreement to sale or gift of the property to another.

    Title Search

    • A title search must be conducted by an attorney or licensed title agency. A search of court records pertaining to the property for the past 40 years is completed by legal professionals. If any clouds are discovered on the title, the property can not be conveyed or refinanced until they are cleared. A cloud is typically a lien levied against the owner for an unpaid debt or tax.

    Transfer of Ownership

    • A transfer fee can be charged to convey interest in real estate. The fee can be either a percentage of the property's value or a fixed amount. The fee can not include a real estate agency commission. Formal transfer of ownership does not occur until a new deed has been filed at the county courthouse.
