Many states, including Kentucky, have stringent rules that require drivers and passengers in motor vehicles to wear seat belts. Kentucky has a primary seat belt law, meaning police officers can stop a driver for not wearing a seat belt.

  1. Kentucky Law

    • Under Kentucky law, the driver and all passengers in a vehicle must be appropriately restrained with a seat belt. Exclusions include USPS mail carriers, persons with disabilities that restrict seat belt use and children in safety seats. Persons with disabilities must carry a physician's note detailing their exemption.

    Children

    • Children less than 40 inches tall should be securely fastened in a federally approved safety seat. A seatbelt is not a suitable substitution for a child safety seat.

    Violation Penalty

    • Persons violating Kentucky's seat belt law will be subject to a ticket and a $25.00 fine, as of 2010. The ticket is not included on the motorist's driving-history record.
