Idaho Law on the Verbal Abuse of Children

Federal regulations dictate a general definition of child abuse, neglect and child welfare. Each state then decrees its own code based on the federal regulations. In Idaho child abuse falls under Idaho Code 16-602.

  1. Definition

    • According to Idaho State Statutes, the term "abuse" includes any mental abuse or psychological impairment that prohibits a child from functioning normally for long or short periods of time.

    Identification

    • The Idaho State Statute Citation Ann. Stat 39-6303 regarding domestic violence also indicates that verbal threats about physical harm, restraint or other types of abuse to a minor child are against the law. This law affects all adults whether parents, guardians or even an adult dating a minor.

    Mandatory Reporting

    • Idaho law requires that any person who believes there is "reason to believe" a child under 18 has been a victim of abuse must file a report. According to Code 16-1605 failure to report child abuse is a misdemeanor. If someone files an abuse report falsely, the fine is up to $2,500 plus court costs and attorney's fees. The court may also instruct the false accuser to pay actual damages over and above court costs to the person who was falsely accused.
