As an individual, you cannot access anyone's driving record without their written permission. Even with their written permission, most department of motor vehicles expect you to have a legally authorized reason for accessing someone else's motor vehicle records.

State regulators give permission to employers to check driving records before a new hire is accepted on the job. The states that don't allow employers to review driving records advise employers to review public records in their background checks. Any motor vehicle-related offenses will be listed in the public records. Insurers who write automobile policies, government and court agencies, towing companies trying to locate owners of towed vehicles and research firms who keep the information protected are all entities who may access motor vehicle records.

Complete a motor vehicle record release request form to initiate the process of obtaining someone's motor vehicle records. The state who issues the driver's license may require the application to be submitted with the driver's written consent. Plus, the requester will have to provide documentation that proves his legally authorized purpose of requested those documents. He may be required to sign an affidavit of intended use. There may also be a fee of $5 to $50 due with the affidavit.
