Indiana Homemade Wine Laws

Indiana Homemade Wine Laws thumbnail
Home winemaking in Indiana is allowed under state law.

It is important for home winemakers to understand state laws regulating the manufacture, use and transportation of homemade wine. In Indiana, the rules pertaining to homemade alcohol are found in Indiana Code sections 7.1-1-2-3 and 7.1-5-8-5. Does this Spark an idea?

  1. Use

    • Indiana does not regulate homemade wine making, as long as it is not sold commercially. Homemade wine can be consumed in the winemaker's home. Additionally, such wine can be offered at fairs, exhibitions, educational seminars and competitions.

    Transportation

    • Indiana Code 7.1-2-3 allows homemade wine to be transported away from the winemaker's home. This is significant because before the current law was passed in 1999, it was illegal to remove homemade wine from the wine maker's residence.

    Licensed Premises

    • Indiana Code 7.1-5-8-5 allows homemade winemakers to bring wine into establishments that hold liquor licenses. However, the wine can only be used for tasting and exhibition purposes.
