The Fair Housing Act, and Massachusetts law, prohibit landlords from refusing to rent a dwelling because of a discriminatory reason. It is illegal to discriminate against a tenant because of his race, color, national origin, religion, age, ancestry, military service, sex, marital status or disability. The application of this law does not apply to owner-occupied two-family rental dwellings.

According to the Massachusetts Sanitary Code, a tenant has the right to live in a healthy and safe environment. The landlord must provide water; a heating system; a kitchen with a sink, stove, and a space for a refrigerator; a dwelling free of cockroaches and rodents; and a rental unit with floors, walls, doors, windows and a roof.

Tenants in North Adams, and all of Massachusetts, have the right to the enjoyment of a rental unit without interference from the landlord. Massachusetts law only allows landlords to enter the dwelling for certain reasons, including to make repairs, to show to prospective tenants or to inspect the unit during the last 30 days of the tenant's occupancy.
