Divorce is not the right choice for all couples, at least not right away. Many times, partners need to think the matter over carefully first. Although there is no such thing as a legal separation in Florida, there is a way for couples to divide their lives without ending their marriage.

  1. Proceedings

    • Florida law does not recognize any separation other than a complete divorce, but couples have numerous ways to divide finances, assets, debts and child care while beginning the process of marriage dissolution. Couples not living together are eligible to request orders from the court for spousal and child support.

    Warnings

    • Be careful about the actions that you take during your separation period -- they could have a negative impact should you decide to later seek a divorce. For example, pursuing a romantic relationship outside your marriage -- even while separated -- can be considered adultery.

    Change of Heart

    • The good news is that if a couple separates while seeking a divorce and then decides to continue the marriage, no legal action is necessary. Courts do not have to be petitioned to recognize an end to the separation. All that is left to do is move back in with your partner.
