California has written laws governing the lease of a room for residential purposes.

California room lease agreements are covered under California Civil Code section 1940 and 1950. Although the state does not have a standard lease agreement form, there is certain information that a landlord is required to disclose in his written lease. In addition there is specific information that although not mandatory should be included in the lease.

  1. Mandatory Disclosure

    • A room lease agreement must contain the following information: contact information for the property manager or owner, contact information for the person to whom lease payments must be made, the form in which payments must be made, and information regarding any sex offender that resides on or near the property.

    Key Terms the Lease Should Include

    • Although it is not required, a room lease should contain the following information: charges for late payment, any utility payments lessee is responsible for, responsibilities of guests, maintenance responsibilities the lessee is responsible for, and other areas of the residence the lessee is allowed to use.

    Warnings

    • When you lease a room in a private residence the owner of the property has the right to enter all areas of the dwelling and has overall control of the entire property.
