PLRA Sentencing Guidelines for Early Release

PLRA sentencing guidelines is aimed at reducing frivolous lawsuits.

The Prison Litigation Reform Act of 1995 provides for limitations on the release of federal inmates who file unnecessary lawsuits. The PLRA is intended to reduce frivolous litigation, which ties up the court's valuable time and resources.

Parameters

In order to apply, the civil action must meet one of three qualifications. These include the filing of the claim for malicious reasons, the filing of the claim to harass the defendant in the suit, or the falsification of evidence or testimony related to the claim.

Concerns

Some opponents of the law think that the inmate may be denied procedural protections if any of these parameters apply based on legal opinion.
