Before a minor parent seeks custody, the court requires the establishment of paternity. Establishing paternity happens through a DNA test or a written acknowledgement of paternity. In certain states, like Oklahoma, a minor father may sign an acknowledgement of paternity form and has the right to rescind the form up to 60 days after turning 18.

Fathers not listed on the birth certificate must be declared the child's legal father before filing for custody. The court determines child custody issues in the best interest of the child regardless of the father's age. The father's age may be a factor, but other items, such as the father's education and financial stability, are considered.

After acknowledgement of being the legal father, the father has other rights and responsibilities, such as right to visitation and the responsibility to support the child financially. The father also has the right to list himself on the birth certificate.
