Kansas Drug Grid Laws

A sentencing grid for drug crimes was created by the Kansas Sentencing Commission.

The Kansas Sentencing Commission created sentencing guidelines implemented into state law in 1993. The guidelines include a separate grid for drug-related offenses.

  1. Criminal and Offense Level

    • The sentencing grid for drug offenses takes into account the degree of seriousness of the crime, where one is the least serious and four indicates the most severe drug offenses. The criminal history of the offender is determined by the number of previous convictions.

    Presumptive Sentence

    • The point on the grid in which the determined offender level meets the offense level indicates the presumptive sentence. The presumptive sentence provides the length and type of sentence the judge can issue without deviating from the standards set by state law.

    Anticipatory Offenses

    • An anticipatory crime includes conspiracy, solicitation or attempt of a criminal act. The presumptive sentence is reduced by six months for anticipatory crimes.

    Probation and Parole

    • The last column of the grid specifies the length of time an intermediate, or non-prison, sentence should be served, as well as the requirement for post-release supervision, or parole.

    Departure Sentencing

    • A judge may deviate from the presumptive sentence only if substantial mitigating reasons justify the departure. A sentence which deviates from suggested sentencing may be appealed in a higher court.
