Arizona Temporary Employee Benefit Rights

Arizona state law and federal labor law require temporary employees in Arizona be paid at least the minimum wage, paid for all hours worked and paid overtime, when applicable. Additional company benefits such as vacation, health care and pensions are not required (as of 2010).

  1. Wage Requirements

    • Under the Arizona wage law, all employees, including temporary employees must be paid the state minimum wage. The minimum wage as 2010 is $7.25 per hour. In most circumstances, temporary workers are also entitled to overtime for hours that exceed 40 in any workweek. The Department of Labor can be contacted t determine if an employee is exempt from overtime.

    Additional Benefits

    • Benefits companies provide such as health insurance, time off programs, and retirement are all at the employer's discretion. Arizona and U.S. labor laws do not, as of 2010, require employers provide such benefits to employees.

    Non-Compliance

    • If a temporary worker believes she is not being paid in accordance with Arizona wage law, she can file a complaint with the Industrial Commission of Arizona. An employee can also file a complaint with the U.S. Department of Labor which has regional offices nationwide.
