Florida restaurants must notify diners if they will automatically add gratuities.

Running any business means navigating a web of local, state and federal laws. For restaurateurs, some of these laws involve gratuities. Thankfully for Florida restaurant owners, the state has only a few laws for the business owner.

  1. Chapter 509 of the Florida Statutes

    • Chapter 509 of the Florida Statutes deals with restaurants. This statute also covers lodging and membership campgrounds. Restaurant owners who want to know more about gratuities and other laws concerning operating the restaurant should consult this chapter of the statutes.

    What the Law Says

    • The only portion of this chapter that deals with gratuities is Section 214. This section states that if a restaurant charges an automatic gratuity, the menus and bills must clearly state this.

    Automatic Gratuities

    • Automatic gratuities refer to tips added to the bill. Many Florida restaurants will do this for special events or if the dining group exceeds a certain size.

    What the Law Doesn't Say

    • The law does not say how much of a gratuity a restaurant may not exceed. The law also does not set a minimum gratuity. Any other laws about gratuities come from the federal rather than state government and are not unique to Florida.
