Illinois Hunter Trespassing Laws

Illegal trespassing and hunting are problems in many areas.

With Illinois being one of the most productive trophy deer hunting states, trespassing by illegal hunters is a serious problem. By understanding the Illinois law on trespassing, landowners may reduce or eliminate trespassing.

  1. Notification

    • The most important facet of trespassing laws in Illinois is that the trespasser must be informed they are not welcome on the land. Landowners may orally tell trespassers to leave, erect "No Trespassing" signs or otherwise inform the trespasser they are to leave or not to enter the land.

    Police Involvement

    • Trespassing is a criminal matter and the police should be contacted whenever trespassing occurs. Landowners should gather as much evidence as is safely possible to assist law enforcement. A physical description of the trespassers and their vehicles can be helpful to law enforcement. Landowners may also initiate civil proceedings against trespassers to compensate for damages.

    Hunting Without Permission

    • In addition to trespassing, hunters who are hunting on private land without permission are also violating state hunting regulations. The Illinois Department of Natural Resources operates an illegal hunting hotline to report violations.
