A service agreement is a contract between two or more parties, where one party undertakes responsibility to provide a specific set of services to the other party or parties, for example, a contract between a wireless telephone company and a customer.

  1. Contract

    • Read the contract and familiarize yourself with its terms, specifically, those terms pertaining to breaking the contract. You may find that breaking the contract will cost you money in termination fees. If there are elements of the contract that are causing you to want to break the contract, it may be easier to try to renegotiate it, instead of break it. Many companies would rather renegotiate a contract than lose your business completely.

    Breach

    • If the service provider has deviated from any of the terms of the contract, the service provider has made a breach of the contract, and this gives you legal grounds to terminate it.

    Breaking

    • If you are sure that you no longer wish to have the service agreement, you may find it better in the long run to break the contract and pay the termination fee. You could simply walk away from a contract, but this might induce the service provider to take civil legal action against you for breach of your side of the contract.

      You could also consider selling or transferring the contract to someone who wants the service you are receiving or, in the case of cell phones, to a reselling service who will sell the contract.
