Renters in Virginia are afforded rights under the Virginia Residential Landlord and Tenant Act.

Renters in Virginia have legal rights and responsibilities as outlined by the Virginia Residential Landlord and Tenant Act. Not all renters in Virginia are protected by the VRLTA, only those who live in housing as outlined by the act.

  1. Types of Housing

    • The VRLTA covers renters who live in motels, hotels, manufactured homes, apartments, single-family houses and Section 8 housing. Single-family home renters are only covered by the VRLTA if the owner owns more than 10 houses. Hotel or motel renters who live in the residence for more than 30 days are covered by the VRLTA.

    Application

    • Under the VRLTA, Virginia renters have the right to a fair application fee. If a renter's application costs more than $32 and is rejected, the owner must refund any money over the actual cost of processing the application within 20 days. If the fee was paid by cashiers check, cash or money order, the owner must refund within 10 days.

    Privacy

    • Virginia renters have the right to privacy under the VRLTA. Landlords are forbidden by law to provide anyone with information about their tenants. Exceptions to this rule exist, including if the information is a matter of public record or is in response to a subpoena.
