Can You Get a Chinese Visa With a Misdemeanor Conviction?

All visitors to China require a visa.

For all U.S. citizens, travel to China requires a visa. The Chinese embassy's Consular Affairs issues several types of visas--tourist, business, work, student, etc.--for a fee. Processing usually takes two to three business days, but express processing can be requested for urgent cases.

Criminal Background Check

Regardless of the type of visa you request, you must complete an application form that includes the question "Do you have any criminal record in China or any other country?" Answering truthfully is key, because false information on declaration forms can lead to serious penalties. This is not a criminal background check, just a declaration. Consular Affairs may choose to perform a background check if you answer yes.

Types of Visas

All types of Chinese visas ask for this information. There are 10 types of visas available: tourist (L), business (F), student (X), work (Z), crew (C), resident journalist (J-1), visiting journalist (J-2), transit (G) and permanent resident (D). To apply for a visa to China, you must fill out the appropriate forms and submit a 2-by-2 inch, recently taken photo to attach to the form.

Visa Durations and Processing Fees

All fees for American citizens traveling to China are the same: $140, regardless of the visa type. You can apply for a single or double entry visa, or for multiple entries for six-, 12- or 24-month periods.
