Are Realtors Exempt From the Do Not Call Registry?
Realtors may place phone calls to prospective clients to generate new sales leads and promote their services, but they may be violating federal laws and the National Do Not Call Registry by doing so.

The National Do Not Call Registry was established in 2003 as part of the changes made to the Telemarketing Sales Rule (TSR). Since this time, consumers have been able to list their phone numbers in the registry prohibiting businesses and sellers from calling them to promote or sell their services. Realtors are considered sellers when they call any consumer to offer or promote their services in exchange for compensation.

Realtors are exempt from the National Do Not Call Registry provisions in several situations. Realtors may call individuals who have given them written permission to call, contacted them in the past three months regarding their services or paid for their services in the past 18 months.

Considerations

Even if an individual is not listed in the National Do Not Call Registry, he may ask a realtor to stop making calls, and the realtor must honor this request as stipulated by law.
