Why Does My Solicitor Need to Talk to a Barrister for an Accident Claim?

Solicitors and barristers are a part of the English common-law legal system. Solicitors will consult with barristers, who are licensed to argue cases in court, if a case has a possibility of going to trial.

You as a claimant

Your solicitor may be consulting with a barrister because someone else may bear legal responsibility for your accident. The accident may have occurred as the result of someone else's negligence in the maintenance of their property or equipment or as the direct result of their actions. In short, you may be able to sue another person or organization to receive compensation for the accident.

You as a respondant

You solicitor may be consulting with a barrister because you may have some liability to others who may have been involved or hurt in the accident. Your solicitor will discuss details, including possible liability, with any individuals who feel they may have been injured or otherwise affected by your actions or negligence, their legal representatives, the courts and the involved insurance companies.

Your interests

Rest assured, it is in your interest to have your solicitor speak with a barrister. Consultations between your solicitor and a barrister are occuring to protect your legal interests. Discuss your concerns with your solicitor, and she will inform you of any legal processes ahead, or further information you will need to know.
