Texas Swimming Pool Safety Laws

Residents of Texas should take safety precautions while swimming.

Pool safety laws in Texas are designed to ensure the safety of all those who swim within the state. Those looking to install a pool on their own property should know the local ordinances that apply. All necessary precautions should be taken to increase the enjoyment for all.

Fence Laws

Those who own or operate a rental complex in Texas that has a pool must ensure that the pool has a fence around it that is at least 48 inches in height. The bottom portion of the fence must prohibit an object that is 4 inches in diameter from passing under. These laws can be found in the Texas Health and Safety Code Section 757.003.

Keeping It Safe

Under the guidelines of the Texas Local Government Code, a municipality has the right to make a swimming pool owner repair or fix any damages to his pool fence in order to ensure the safety of those around. Residents who do not make the necessary repairs can be fined a maximum of $1000.

Telephones

As of Sept 1, 2004, all public pools in the state of Texas must have a properly working phone within 200 feet of the pool. The purpose of the phone is to contact emergency units in the event of an accident.
