Every state in the United States has laws regulating the operation of a motor vehicle. Although the substance of each state's laws vary (such as the amount of a fine or the amount of points for a given infraction), the form of driving laws are fairly consistent.

    • The observation of a law enforcement officer (often with the aid of a radar gun or other electronic device) that a car is traveling at a speed in excess of a posted speed limit is sufficient to support a conviction for speeding.

    Location

    • Because a conviction for speeding can be sustained on the reliable observation of a law enforcement officer, where a person is ultimately pulled over and issued a citation for speeding does not matter. For instance, if law enforcement is using a helicopter to monitor the speed of motorists, the patrol car that ultimately pulls over a speeding motorist may validly pull over the motorist several miles up the road.

    Jurisdiction

    • As long as a patrol officer observes the speeding violation within his jurisdiction, he may pull over the motorist and issue the ticket in another jurisdiction. For instance, a police officer of one town may be able to pull over a motorist for speeding in another town.
