Kansas Funeral Home Regulations

Funeral homes in Kansas must be licensed by the Kansas State Board of Mortuary Arts (KSBMA). Relevant laws, rules, and regulations that affect funeral home operators can found at the KSBMA website. Specific Kansas funeral home statutes commence with Kansas Statutes Annotated (K.S.A.) 65-1729. More than 200 funeral homes are licensed by the state of Kansas.

  1. Kansas State Board of Mortuary Arts

    • The KSBMA handles licensing and regulation for funeral establishments, also known as funeral homes. The agency regulates and licenses funeral directors, crematoriums, mortuaries, anatomical gifts, embalmers, mausoleums, prearranged funeral plans and apprentices working in funeral homes (K.S.A. 74-1701(a)).

    General Provisions

    • It is a violation of state law for any person or entity to operate, respectively, as a funeral director or funeral home without obtaining a valid license. Funeral directors and embalmers are required to take and pass an examination as a condition of issuance of a license. A KSBMA fee schedule is contained in K.S.A. 65-1727. To renew a license, licensees must provide proof documenting compliance with continuing education requirements.

    Rules and Regulations Affecting Operations

    • The KSBMA is authorized to enforce funeral regulations and discipline licensees for illegal and/or unprofessional conduct; penalties can include permanent revocation of a license and/or issuance of fines. Funeral establishments are required to obtain a permit for each branch location. Funeral homes must submit monthly reports to the KSBMA for each funeral conducted.
