Business names are usually registered with the secretary of state.

Legal entities trade or operate a business under a registered business name. The legal name of a business is required on all government forms and applications. The procedure for registering a business name may differ by business type or state.

  1. Sole Proprietor

    • The legal name of a sole proprietorship is usually the full name of the owner. The owner may also opt to register a fictitious business name or DBA (doing business as) with a government agency if they prefer not to use their personal name.

    Partnership

    • The legal name of a partnership is usually the last names of each partner or the name given in the partnership agreement.

    Limited Liability Corporation or Corporation

    • The business name of a limited liability corporation (LLC) or corporation is usually registered with the state in which the business plans to operate. A corporation or LLC that operates multiple businesses may register a DBA under their business name for each additional business venture.
