A settlement agreement is a contract between parties of a lawsuit or other dispute that sums up the negotiated resolution of a case. A settlement agreement is used in all types of cases, from divorces to personal injury proceedings. A procedure exists if the settlement agreement is violated.

A violation of a settlement agreement is, technically, a breach of contract. The victim of a breach can sue the party that violated the agreement.
Time Frame

The statute of limitations for a breach of contract governs the time frame in which a lawsuit for violation of a settlement agreement must be filed. The deadline varies from one state to another, but typically is two or three years.

The person who breached the contract is the one who pays for the attorney fees and other costs associated with a claim or lawsuit filed by the other party.
